Cache County zoning code

17.06.060 NONCONFORMING USE

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Cache County code is at https://www.cachecounty.gov/assets/department/clerk/cachecountyut-ut-2.pdf. Text pulled 2026-10-19 from this source. Titles 16 and 17 only, from the PDF on the county's own website (prepared by its code publisher; publisher notes removed). Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Cache County planning before you rely on it.
A. Continuation Of Use: A nonconforming use may continue provided that it: 1. Is determined to legally exist prior to the effective date of the applicable ordinance, or legally established by the action of a federal, state, or local government entity; and 2. Has been continuously maintained. B. Alteration Of A Nonconforming Use: 1. A nonconforming use shall not be enlarged upon, expanded, or intensified. 2. A nonconforming use may be maintained, however, for any work that requires a building permit, a zoning clearance shall be issued that identifies the following: the nonconformity, the legally nonconforming status, and that the use is not being enlarged, expanded, or intensified.
