Cleveland zoning code

2-6.2 DETERMINATION OF NON-CONFORMING STATUS

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Cleveland code is at http://www.clevelandtown.org/planning--zoning.htm. Text pulled 2026-10-19 from this source. Zoning ordinance only; the subdivision ordinance is a scanned image on the town's site and is not included. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Cleveland planning before you rely on it.
A. BURDEN ON OWNER TO ESTABLISH LEGALITY. The owner bears the burden of establishing that any non-conforming use or noncomplying structure lawfully exists. Acceptable documentation shall include plat maps, tax records, previous zoning ordinances, and building permits. B. DETERMINATION OF STATUS. The Planning Commission shall determine the non-conforming or non- complying status of properties. Any decision of the Planning Commission may be appealed within ten (10) calendar days of the final decision to the Appeal Authority.
