30-1 MINING, QUARRY, SAND AND GRAVEL EXCAVATION OPERATIONS: Purpose and Intent

A. As residential development is near or anticipated to be near excavated or potential excavated land, it is the purpose and intent of this ordinance to establish reasonable and uniform limitations, safeguards, and controls on excavation activities, both as a regulated land use category and under the police power, within the incorporated areas of the City. These provisions are deemed necessary in the public interest to affect practices which recognize nearby residential land and will provide protection of the tax base, provide for the economical use of vital materials necessary for our economy and give due consideration to the present and future use of land in the interest of promoting the public health, comfort, safety, community character and general welfare. It is the intent of this ordinance that excavated land be rehabilitated as soon as possible to prevent conditions detrimental to neighboring property and residents, and to provide for the subsequent beautification and beneficial use of the lands affected by excavation. B. It is also the intent of this ordinance to avoid unnecessary, duplicative, overlapping or conflicting regulations to the extent reasonably practicable by incorporating herein the requirements of DOGM so far as they are not in conflict with City requirements. C. It is the intent to not apply this ordinance to those provisions listed as exceptions in section 30-2(E)(1).
