Erda zoning code

7-13 CONDITIONAL USES: Revocation

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Erda code is at https://erda.gov/city-codes-and-maps/. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Erda planning before you rely on it.
1. A conditional use permit shall be revocable by the planning commission at any time due to failure of the permittee to observe any condition specified or failure to observe other requirements of the Erda Land Use Ordinance in regard to the maintenance of improvements or conduct of the use or business as approved. The City Council shall also have a right of action to compel offending structures or uses to be removed at the cost of the violator or owner. 2. No conditional use permit shall be revoked until a hearing is held by the planning commission. The permittee shall be notified in writing of such hearing. The notification shall state the grounds for complaint or reasons for revocation, and the time and location at which the hearing is to be held. At the hearing, the permittee shall be given an opportunity to be heard. The permittee may call witnesses and present evidence. Upon conclusion of the hearing, the planning commission shall determine whether the permit should be revoked.
