Millville zoning code

17.14.050 HAZARD WATER TABLE AREA (HW)

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Millville code is at https://millvilleut.gov/city-government/citycode/. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Millville planning before you rely on it.
An area where potential groundwater levels may occur within 12 feet (12’) of the natural grade is designated as a Hazard Water Table Area. Within a Hazard Water Table Area, no permit shall be issued for any construction or use until a conditional use permit has been obtained in compliance with Millville City code. A conditional use permit shall not be approved until adequate plans and engineering data are delivered to the Land Use Authority showing that no basement or cellar is to be built, that the percentage of the lot, parcel or site to be covered by buildings, parking spaces and paved surfaces does not exceed forty percent (40%) of the area of the lot, parcel or site and that the proposed use is not of a character to increase quantities of chemicals, fertilizers, pesticides or minerals or in any other way likely to contaminate the groundwater.
