New Harmony zoning code

3-10 Stay of Proceedings Pending Appeal

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official New Harmony code is at https://newharmonyutah.org/wp-content/uploads/2020/04/nh-land-use-ordinance-2-3-20.pdf. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with New Harmony planning before you rely on it.
An appeal stays all proceedings in furtherance of the action appealed from, unless the officer from whom the appeal is taken certifies to the New Harmony Town Board of Adjustment after the notice of appeal shall have been filed with him or her that by reason of facts stated in the certificate a stay would in his or her opinion cause imminent peril to life or property. In such case, proceedings shall not be stayed otherwise than by restraining order which may be granted by the New Harmony Town Board of Adjustment or by district court on application and notice and on due cause shown. .3-11 Decision on Appeal. In exercising the above-mentioned powers, the New Harmony Town Board of Adjustment may in conformity with the provisions of this Ordinance reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination appealed from and may make such offer, requirement, decision, or determination as ought to be made, and to that end shall have all the powers of the officer from whom the appeal is taken.
