Newton zoning code

11-8-5 Wall, Fence, Or Hedge Height

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Newton code is at https://cms8.revize.com/revize/newtonut/TITLE%2011%20LAND%20USE.pdf. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Newton planning before you rely on it.
A. No fence or wall or other similar structure shall be erected in any required front, rear or side yard to a height in excess of six feet (6’), except for accessory buildings and structures permitted herein, and as allowed by a conditional use permit. Where there is a difference in the grade of the properties on either side of a fence or wall; the height of the fence or wall shall be measured from the average elevation of finished grades of the adjoining properties in question at the fence line, except that no fence need be less than forty two inches (42") in height. B. A retaining wall may be topped by a fence, wall or hedge of the same height. No fence should be over six feet (6’) if on a retaining wall two feet (2’) high. If a retaining wall is higher than 36 inches it will require a conditional use permit.
