13.28.060 FINANCIAL RESPONSIBILITY: Guarantee for One Year

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Sanpete County code is at https://www.sanpetecountyutah.gov/174/Planning-Zoning. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Sanpete County planning before you rely on it.
1. The applicant upon submission of their plans, shall deposit with the County a fee in the amount required by the Board of County Commissioners, to cover engineering review and inspection of the above improvements. 2. The applicant shall warrant and guarantee that the improvements provided for in this chapter, and every part thereof, will remain in good condition for a period of one (1) year after the date of conditional acceptance by the Board of County Commissioners and agree to make all repairs to and maintain the improvements and every part thereof in good condition during that period at no cost to the County. It is further agreed and understood that identifying necessity for repairs and maintenance of the work rests with a civil engineer licensed by the State of Utah, whose decision upon the matter shall be final and binding upon the applicant, and the guarantee stipulated shall extend to and include but shall not be limited to the entire street, subgrade, base and surface and all pipes, joints, valves, backfill and compaction as well as the working surface, curbs, gutters, sidewalks and other accessories that are, or may be affected by the construction operations. 3. Whenever, in the judgement of the County, said work shall be in need of repairs, maintenance or rebuilding, they shall cause a written notice to be served to the applicant. Upon receipt of such written notice, the applicant shall undertake and complete the repairs, maintenance or rebuilding as required by the above-stated written notice. The cost of such repairs, maintenance or rebuilding shall be paid by the applicant. Should the applicant fail to complete such repairs, maintenance or rebuilding as are required by written notice, within a reasonable time from the date when such notice was received (not to exceed six (6) months), the Board of County Commissioners may initiate any and all legal actions necessary to compel compliance with the requirements of the written notice.
