Each and every continuing violation of any provision of this Code is declared to constitute a nuisance. Private citizens of and/or property owners in Wallsburg Town shall also have the right to commence and pursue formal civil legal proceedings with respect to any ongoing violations affecting their interests, provided that no such legal action shall be filed until after the expiration
of thirty (30) calendar days from the date that a written notice of intent to commence such legal
proceedings is actually received by the Town Recorder. The prevailing party in any such private
civil legal proceedings shall be entitled to an award of reasonable attorney’s fees incurred in
pursuing or defending such action.”
Section 2: If any provision of this Ordinance, or the application of such provision to any person or circumstance, shall be held invalid or unenforceable for any reason, the remainder of this Ordinance, or the application of such provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby.
