Wellington zoning code

7-2 BUILDING PERMIT REQUIRED

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Wellington code is at https://www.wellingtonutah.gov/land-use-code.html. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Wellington planning before you rely on it.
No building or other structure shall be erected, moved, added to, or structurally altered without a permit therefor, issued by the Administrator. No building permit shall be issued by the Administrator except in conformity with the provisions of this Ordinance, unless he receives a written order from the Variance Committee in the form of an administrative review, or variance as provided by this Ordinance. 1. No permit shall be issued for any building, construction, or repair of any building unless said building, construction, or repair fully conforms to all zoning regulations or ordinances of this municipality in effect at the time of application. 2. No permit shall be issued for any building or structure or part thereof on any land located between the mapped lines of any street as shown on any official street map adopted by the City Council. However, the Variance Committee shall have the power, upon an appeal filed with it by the owner of any such land, to authorize the grant of a permit for a building or structure or any part thereof within any mapped street located in any case in which the Variance Committee upon the evidence finds: a. that the property of the appellant of which such mapped street location forms a part will not yield a reasonable return to the owner unless such permit is granted, or that balancing the interest of the city in preserving the integrity of the official map and the interest of the owner in the use and benefits of the property, the grant of such permit is required by consideration of justice and equity, or that denying the special exception would constitute an unconditional prohibition of development of the property. b. Before taking any such action, the Variance Committee shall hold a public hearing thereon. In the event that the Variance Committee decides to authorize a building permit, it shall have the power to specify the exact location, ground area, height, and other details and conditions of extent and character and also the duration of the building, structure, or part thereof to be permitted.
