Elsinore zoning code

Section 11, Subsection 8 Exceptions to specific application and plat requirements

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Elsinore code is at https://www.elsinoreut.com/land-use-ordinances/. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Elsinore planning before you rely on it.
A. Agricultural Land: 1. Applications to subdivide agricultural land are exempt from the preliminary and final plat and improvement plan requirements (but not the other application requirements) of Subsection 6 and 7 if the resulting parcels: a. Qualify as land in agricultural use under Utah Code §59-2-502; b. Meet the minimum size requirement of applicable Town land use ordinances; and c. Are not used and will not be used for any nonagricultural purpose. 2. For subdivision applications for which this exception applies, an applicant may submit to the Town—in place of a plat—a record of survey map that illustrates the boundaries of the parcels. 3. If the Town approves a subdivision application based on a record of survey map, the applicant shall record the map, signed by the Town, with the County Recorder’s Office. This shall be done in the same manner as is done for a plat under Subsection 8. 4. If a parcel resulting from a subdivision under this exception ever ceases to be used for agriculture, the subdivision shall no longer be exempt under this Subsection and shall be required to conform to typical plat requirements. The Town may, in its discretion, impose the penalty in Subsection 1(F) and/or require a subdivision amendment before issuing a building permit. B. Development Agreements: 1. At the request of an applicant, the Town may approve a subdivision through a development agreement entered into between an applicant and the Town. 19 a. The Town Council shall not enter into any development agreement until the Planning Commission has held a public hearing and provided a recommendation to the Town Council. 2. Subdivisions platted in a valid development agreement are exempt from the application and review and approval requirements of this Section. 3. Clauses in a valid development agreement with the Town superseded all conflicting requirements in this Section, except where a clause in the development agreement poses a substantial danger to the health and safety of Town residents.
