10-17-7 HOME OCCUPATION PERMIT APPLICATION PROCEDURES

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Fruit Heights code is at https://www.fruitheights.gov/201/Municipal-Code. Text pulled 2026-10-19 from this source. Partial copy: about 20 chapters (most zone and administration chapters, ch. 1-7, 8A-8C, 8E, 9A-9B, 10B, 12-15, 19-20) are scanned images on the city's site and are not included. Use the official code for those. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Fruit Heights planning before you rely on it.
A. Home Occupation Permit Required: In accordance with the provisions of Section 1017-4, a home occupation permit is required to be obtained from the zoning administrator before a dwelling unit may be used for business or commercial purposes. B. Application: Application for a home occupation permit shall be made to the zoning administrator by the property owner or agent certified in writing on forms provided by the city for such purposes. Such application shall describe the nature of the proposed home occupation referencing the applicable standard industrial classification codes, and provide other such pertinent information as required in order to enable the zoning administrator to determine compliance with other sections of this chapter relative to performance standards as well as other applicable city ordinances. The complete application shall include completion of the city's industrial discharge, flammable materials, chemicals, and hazardous waste questionnaire, as applicable. The application for a home occupation permit license will not be processed by the zoning administrator until all of the elements of the application are complete. C. Fees: The application for a home occupation permit shall be accompanied by an application fee as established by the city council or such other amount as established by the city council from time to time and published as part of the application for home occupation permit. If the city conducts an inspection pursuant to the authority granted in subsection F of this section, the fee or the actual cost of such an inspection shall be added to the application fee. Additional business licensing fees may be applicable. D. No Return Of Fees: If the application for a home occupation permit is denied, the fee paid by the applicant shall be retained by the city to pay for the costs of processing such application. F. Review And Approval Procedure:Upon receipt of a complete application, the zoning administrator shall review the application for compliance with all applicable city ordinances. The zoning administrator may require a written certification or other reasonable assurance that the applicant will comply with all applicable laws, including state and federal statutes and regulations. An inspection of the dwelling unit proposed for the home occupation may be conducted by any competent authority having jurisdiction to enforce compliance with applicable laws as a condition precedent to approval of the application. The zoning administrator shall review and approve or deny the home occupation permit based on compliance with the terms, conditions and requirements of this chapter and applicable city ordinances. The zoning administrator shall notify all applicants of his or her decision regarding the application, in writing, within a reasonable time from receipt of a completed application.
