14-13-030 MIXED USE ZONE: Legislative Approval and Development Agreement

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Salem code is at https://www.salemutah.gov/salem-city-codes.htm. Text pulled 2026-10-19 from this source. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Salem planning before you rely on it.
The Mixed Use Zone is a legislative zoning designation. A Development Agreement approved by the City Council shall be required concurrently with approval of any Mixed Use zoning designation. No property may be zoned Mixed Use without an approved Development Agreement. The Development Agreement shall govern the development of the property. In the event of a conflict between the Development Agreement and the default standards of this Chapter, the Development Agreement shall control, except where this Chapter establishes a maximum or minimum standard. No subdivision plat, site plan, building permit, conditional use permit, or other development approval shall be granted until the Development Agreement has been approved and executed. The Development Agreement shall establish the project-specific development standards governing the development, including but not limited to: A. Commercial land use allocation; B. Residential product types; C. Development phasing; D. Infrastructure improvements; E. Parks, trails, open space, and community amenities; F. Architectural and design standards; G. Parking requirements; H. Landscaping requirements; I. Building setbacks and lot configuration; J. Commercial development timing; K. Maintenance obligations; L. Financial guarantees; M. Reimbursement agreements; and N. Other project-specific requirements determined necessary by the City Council. Approval of a Mixed Use zoning designation does not establish vested rights to any specific residential density, housing type, building height, commercial intensity, development configuration, or modification of City standards except as expressly provided in the approved Development Agreement. All dedicated infrastructure, public improvements, open space dedications, and impact fees required under this Chapter or an executed Development Agreement shall strictly comply with applicable Utah State law governing development exactions. The Development Agreement shall be recorded against the property and shall run with the land unless amended or terminated in accordance with applicable law.
