Tooele County zoning code

35-8-4 Boundary adjustments

Unofficial copy. It may be out of date. Not legal or zoning advice. Zoning rules change, and only the city or county can say for sure what is allowed on a property. Confirm with the city or county planning department before you buy, sign or build. The official Tooele County code is at https://www.tooeleco.gov/departments/development/land_use_ordinance.php. Text pulled 2026-10-19 from this source. Chapter 19 is a scanned image on the county's site and is not included. Tables (like use tables) may not copy cleanly, so check any table against the official code. Confirm anything here with Tooele County planning before you rely on it.
The parcel owners of record may submit a proposal to the land use authority to adjust boundary lines of parcels, if not within a subdivision. If the properties are located within a platted subdivision, a plat amendment is required that corresponds with the full boundary adjustment. (1) For Simple Boundary Adjustments, the Land Use Authority shall provide a Notice of Consent once the applicants have submitted an application and complied with the following requirements: (a) include a conveyance document that complies with UCA 57-1-45.5; (b) describe all lots or parcels affected by the proposed boundary adjustment; and (c) include a graphical exhibit of all properties affected by the adjustment, depicting: (i) former boundary location; (ii) new boundary location; and (iii) size, shape and dimensions of each adjusted property. (2) Simple Boundary Adjustments cannot: (a) affect a public right-of-way, county utility easement, or other public property; (b) affect an existing easement, onsite wastewater system, or an internal lot restriction; or (c) result in a lot or parcel out of conformity with land use regulations. (3) Simple Boundary Adjustments are not subject to a public hearing or meeting. (4) If the land use authority determines that a proposed simple boundary adjustment does not meet the requirements of Subsection (2), a full boundary adjustment is required. (5) For Full Boundary Adjustments, the land use authority shall provide a Notice of Consent once the applicants have submitted an application and complied with the following: (a) a conveyance document that complies with UCA 57-1-45.5; (b) a survey that complies with UCA 57-1-4.5(3)(b); and (c) the survey described in Subsection (2)(b) shows no evidence of a violation of a land use regulation. (6) The recording of a boundary adjustment does not constitute a land use approval. (7) Consent of these adjustments is an administrative act. (8) Notice of consent under Subsection (1) or (5) shall be provided to the person proposing the boundary adjustment in a format that makes clear: (a) the land use authority is not responsible for any error related to the boundary adjustment; and (b) a county recorder may record the boundary adjustment. (9) A boundary adjustment is effective from the day on which the boundary adjustment, as consented to by the land use authority, is recorded by the county recorder along with the relevant conveyance document. (10) A county may enforce county ordinances against, or withhold approval of a land use application for, property that is subject to a boundary adjustment if the county determines that the resulting lots or parcels are not in compliance with the county’s land use regulations in effect on the day on which the boundary adjustment is recorded. (Ord. 2025-11, 8/19/25; Ord. 2022-32, 11/29/22)
