A. If a project involves multiple parcels with different ownership, a Land Use Plan shall be provided (see Chapter 15) in order to coordinate circulation, walkability, shared parking, stormwater infrastructure, utility placement, and phasing of residential and nonresidential uses. Applicants with properties under common ownership may pool their requirements across parcels.
B. At least thirty percent (30%) of any approved housing shall be designed and platted to allow for individual ownership (townhomes or condominiums).
C. The number of residential units allowed in a mixed use project shall be based on the Maximum TOD and Mixed Use Density Map 05.010, and shall be directly proportional to the number of units available and the size of the property unless otherwise approved by the City Council, following review and recommendation by the Planning Commission.
D. A minimum of fifty percent (50%) of the total finished interior gross floor area within the development shall be devoted to nonresidential uses, including retail, office, restaurant, and civic uses. For developments exceeding two (2) acres in total project area, the minimum required nonresidential floor area shall increase by one percent (1%) for each additional acre or fraction thereof, up to a maximum requirement of seventy percent (70%). Amenity space (ie. gym, spa, etc.) may be counted if they are open to the public or tied to an allowed commercial use.
E. No more than 60 percent of any approved residential units may receive certificates of occupancy until at least
Adopted 01/13/15
the required minimum nonresidential floor area has received a certificate of occupancy. The City Council, following review and recommendation by the Planning Commission, may approve alternative phasing if the applicant demonstrates that site, market, or infrastructure conditions justify a modified schedule and that the long-term mix of uses will still be achieved. Any alternative phasing must maintain or exceed the required nonresidential square footage and be based on measurable site, market, or infrastructure conditions.
F. Ground-floor nonresidential or convertible commercial space shall be required for building frontages facing Main Street, State Street or any other collector or minor arterial street, or buildings located within 300 feet of a transit stop. The ground floor along required frontages shall be constructed with:
1. Direct pedestrian access from the sidewalk; 2. Primary building entrances facing the public street; and 3. Transparent glazing measured between 2 and 10 feet above adjacent sidewalk grade on at least 50 percent of the façade area.
